Guardianship

A testamentary guardian is someone you appoint in your Will to make decisions on your children's care and upbringing if both parents or guardians pass away before the children turn 18. They don't automatically take over day-to-day care but help decide who has the day-to-day care, as well as make decisions about your children's welfare, education, and upbringing.

If you have minor (under 18 years) children, who do you want to name as a testamentary guardian(s)? Insert the guardian's FULL name including middle names, place of residence (eg Auckland, Wellington, Sydney), occupation and your relationship to them eg. mother, sister, friend.

Executors and Trustees

Executors and trustees are the people responsible for carrying out the instructions in your Will. An executor manages your estate after you pass away. They collect your assets, pay any debts, and make sure your Will is followed. A trustee looks after any ongoing assets or trusts created under your Will, such as funds held for children until they reach a certain age. Often, the same person acts as both executor and trustee.

Enduring Power of Attorney (EPA)

This section helps us gather the information needed to prepare your Enduring Powers of Attorney. These documents let you choose someone you trust to make decisions on your behalf if you can't do so yourself. Please fill in as much detail as you can. Don't worry if you're unsure about something, your lawyer will go through it with you and explain everything before your documents are finalised.

EPA – Personal Care and Welfare

This section covers who you wish to appoint as your attorney for personal care. This EPA allows the person you appoint (your attorney) to make decisions on your behalf about your personal care and welfare if you become mentally incapable of making these decisions yourself. These decisions might include your living arrangements, medical care, and general wellbeing. Your attorney can only act if a doctor provides a certificate stating that you are mentally incapable of making those decisions yourself, and your attorney must follow any conditions or limits set out in your EPA and under the law. You can only appoint one attorney to act at a time. However, you can require that your attorney communicates with other specific people (such as other family members) about decisions they make on your behalf. You should also appoint a successor attorney (a backup) to step in if your first choice can no longer act. You should choose people you trust, aged 20 or over, not bankrupt, and mentally capable. It's helpful if they live nearby so they can assist in person when needed. Your lawyer will discuss this with you in detail and make sure you understand how it works before the documents are finalised and you sign.

EPA – Property

This section covers who you wish to appoint as your attorney (or attorneys) for property. This EPA allows the person (or persons) you appoint (your attorney or attorneys) to make decisions on your behalf about your property and financial matters. This can include paying your bills, managing your bank accounts, or making decisions about your home and investments. You can authorise your attorney (or attorneys) to act for you while you still have mental capacity, or only if you become mentally incapable. If you wish, you may appoint more than one attorney to act at the same time, but you will need to specify whether they can each act independently or are required to act jointly. You should only appoint someone you trust, aged 20 or over, not bankrupt, and mentally capable. Your lawyer will discuss this with you in detail and make sure you understand how it works before the documents are finalised and you sign.
